Terms of Service

1. Acceptance of Terms

By accessing or using SparkWren ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

SparkWren provides a workflow automation and data processing platform that allows users to create, deploy, and manage automated workflows connecting various applications and services.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit malicious code or interfere with the Service
• Attempt to gain unauthorized access to other accounts
• Use the Service for spam, phishing, or fraudulent activities

5. Payment Terms

Paid plans are billed monthly or annually as selected. All fees are non-refundable except as required by law. We may change pricing with 30 days notice.

6. Data Ownership

You retain all rights to your data. We do not claim ownership of any content you process through SparkWren. We use your data only to provide and improve the Service as described in our Privacy Policy.

7. Service Level Agreement

We strive to maintain 99.9% uptime for all paid plans. Enterprise customers receive custom SLAs with financial credits for downtime. See our Status page for current availability.

8. Limitation of Liability

SparkWren shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. We will provide data export capabilities for 30 days following termination.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.

12. Intellectual Property

SparkWren and its original content, features, and functionality are owned by SparkWren Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

13. Indemnification

You agree to indemnify and hold harmless SparkWren, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
